Cancellation or non renewal car insurance

My car insurance wants to charge me £40 to not renew my car insurance,  this is a cancellation fee. I'm not cancelling, I'm just not renewing.  Why should I pay a fee ?

If your policy has expired, they are not allowed to charge a fee if you choose not to renew.

What insurance company is this. And what does it say in your terms and conditions re cancellation? Did you tell them that you were not renewing from the end date or just that you wished to cancel? Has the policy already been renewed by the insurance company?
    Is it Swintons?

You're not cancelling, get that phrase and terminology out of your head (no offence).
    You're just not renewing.
    Big difference.

Did you contact them and use a phrase that they have misinterpreted as cancel?
That seems to be me to be the most logical thing that has happened here.

It does sound likely that this is what happened?  Whenever I do not wish to renew, I ensure that the company understands that I am not cancelling .but do not wish to renew from the policy end date.

You are not cancelling!! you are not renewing from policy end date. Be specific in what you are saying to them.
