Section 75 claim

I booked some flights through a third party website (go to gate). But due to my wife’s medical condition we are unable to fly. I contacted both the agency and Turkish airlines both refused to refund me or change the names on the ticket, can I claim under section 75 for this?

    No is the simple answer as you used a 3rd party rather than the airline.
    But S75 would not cover your case anyway. As it does not cover you not being able to go. Put simply it is you who is breaching the contract, not the retailer. You need to look at your travel insurance to claim anything back. 
    Which is why travel ins should be booked at time of any travel booking.

    No.

    Neither the agency nor the airline is in breach of contract so have done nothing wrong, so it's travel insurance that you need to cover events like this.

    In any case, section 75 wouldn't apply to purchases made via intermediaries such as travel agents.

    section 75 would not work even if you had booked direct with the airline as the flights and hotel are still available for you to use.
    Any refund on the flight would be based on the fare rules of the ticket you asked them to purchase, if they are non-refundable then there is no refund - there may be some taxes to come back but the third party fees would likely wipe this out.
    Does your travel insurance cover your wife's medical condition? if so then that is the route for any refund (as per your policy, excess etc) If not then there is nowhere to claim from.
    Most airlines do not permit name changes.

  • Unfortunately we did not take travel insurance out. I usually take this out a day before flying so kind of snookered myself there.

    I usually take this out a day before flying
    I take travel insurance as soon as I book something that will cost me money to cancel
    Fully refundable hotel/flight - won't need travel insurance until travel....as if need to cancel in advance all refundable so no loss.
    non-refundable hotel/flight - choice is the take travel insurance or self-insure...by self insuring you carry the full loss yourself.
    Are date changes for a fee an option?
