Hi does anyone have any experience of this company?  My student loan was handed to them from Erudio Studios Ltd.  I pay them a monthly amount by standing order.  Last month I had a letter from them and I tried to call and the wait was over 60 minutes so I opted to leave my details.  No one called me back.  Today I have received another letter saying unless I make the remaining payment in full (£3K+) it is going to County Court.  I have tried to call again and the wait is over 69 minutes so I left details for a call back.
I have also written to them via recorded delivery detailing this.  I have expained that I am currently signed off from work with stress looking after a sick child and this isnt helpful.
Does anyone have any advice, I am at my wits end with them?
Thanks in advance

Keep communicating with them.  If you are demonstrating a willingness to pay, then a CCJ is very unlikely.

But I wouldn't tell them that collecting a debt isn't 'helpful'.  It won't play well.  Jut be polite with them.

Thank you.  It is very difficult to get hold of them with excessive waits on the phone and no email address available.  Hopefuly they will respond to my letter today.
    Thank you

I would not bother trying to speak to Dryden's, they are mega busy, and very rude, they bulk mange legal claims for the debt collection industry, they are not interested in your sob stories, all they want will be full payment or it goes to court, that is there Modus Operandi on the phone.
Best putting it in writing, also are they just acting on behalf of Erudio, what were the original repayment terms ?
If you write and ask for proof of the debt, and under what legal assignment they are acting, they will most likely return the debt to Erudio, as they are not interested in the niceties of providing proof of liability, just a little heads up for you.

They have rang me back today and have said they cannot stop the CCJ going ahead, despite me paying the debt off each month by standing order.
  • Sounds like bully boy tactics on the phone. Wait for any paperwork to arrive - no paperwork no ccj - assuming they have your correct address. Seek advice on how to defend any court action from here or sites like Legal Beagles.

Most probably just scare tactics. If it does go to court offer them less money per month.

They cannot stop it going ahead, (chuckles to himself), maybe not, but you can put forward a defence, it’s never a done deal till the fat lady sings.
As above, check out legal beagles, they have a whole section on court claims.

As said, let it go to court and set out a detailed income/outgoing list that shows you can only pay a pittance towards it each month.

Which begs the question "why did they call you back"

  • Thank you so if it goes to court and I offer to continue paying monthly will that mean that the CCJ will not go against me?

It does not work that way, if you want to stall them, I have told you how to proceed above, asking for evidence of a debt puts everything on hold, whilst they obtain it, including court action, that`s why i gave a chuckle above, they tell you any old rubbish on the phone, write and ask for proof, and its more than likely the threat of any further action will just vanish, they don`t like complications such as asking for proof of a debt.

I had a very similar experience with an old payday loan, a few years ago, they told me the same rubbish they have told you, i wrote to them, asking for evidence of the debt, after 9 months, they could not provide any, this was in 2012, i have not heard from them since, (the debt was cleared in the end).
