Thanks Fruitcake, got it now! Very useful. Be interesting to see from what date they use for there signage exhibits.

It was a car park in Burton that three posters on this forum fought claims. Another one is ongoing. One of the three posters had two separate claims. On the final claim she was allowed costs for unreasonable behaviour.  Three hearings were at Derby and one (mine) at Stafford.  A very expensive exercise for Excel/VCS.

Fruitcake is very good at spotting evidence in the car park that supports the legal argument.  The Burton on Trent car park was a nightmare.  It's the one by the Travelodge/Station.  Like where you were parked there is a lot of random signage that is not related to the car park. Delivery lorries etc.

Good to know there a number of positive results from Derby Court against VCS. I thought at first it was for the Lidl car park on Normanton Road in Derby as I know this is a hot spot for PCN's!!!

Is it recommended to complete and send off my necessary documents ahead of the hearing date at the earliest convenience or will they not be considered by a claimant or the courts until closer to the time?

Buller65, why have you hijacked someone else's thread?

You need to read the sticky thread for NEWBIES that asks you to read it before posting, then start your own thread where you will get bespoke help. You will get no help here and must delete your post otherwise you will get nothing but negative posts telling you to remove yours and start your own thread.

Sorry posted on wrong account originally and now deleted!!

    Hi,

A couple of months down the line, was not holding my breath I would receive anything from VCS in terms of a WS or proof of contract with the landowner or details of the added costs that the Judge requested in the Notice of Trual . And you guessed it....still nothing. My court date is the 12th September in Derby and we were asked to send WS 28 days before. Therefore I have pulled together my WS/Evidence/Schedule of cost's

    I have tried to keep it simple, to the point and focus mainly on the lack of signage upon entry to the car park. A few questions I had;

    - Would it be advised to make more of the Abuse Of Process £60 added costs in my WS or if I covered it all in detail in my defence can I then refer back to that? I have seen someone else submit a supplementary WS referring solely to the Abuse of Process part. I am just conscious I wanted to get it fairly short and sweet and can go into this in more detail in court if needed.
    - There is signage on the far wall of the car park which I have touched on being inadequate and not near where I parked. Would it be advised to not mention this at all or make more of it?
    - Do I submit my WS & Schedule of cost's all together or submit the costs later?

If anyone has any other feedback it would be much appreciated

    Thanks

    Zeus

If it was in your defence in detail, you don't need to go into detail again in the WS - just attach this attachment I;ve uploaded and refer to it as an exhibit, it includes all the known strike-outs for abuse of process, including VCS where they were tirn off a strip by Caernarfon for repeatedly filing '+£60 damages' falsely inflated claims.

Menton it but no close-up photos of it!

I prefer to do it all together at WS stage, so you don't forget and so the C can't say they were ambushed with the costs late, or that they never received them!

Your WS looks fine but I would attach this (below) as well.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks CM - much appreciated advice and support. Will add in the Exhibit and reference in WS and check with the court they still want it sending there and it is still a hearing on that date in the Derby Court!

So....went out for a lovely game of golf this morning in the sun. Stopped off on the way home to pick up some more paper and ink for my printer to print copies of my court bundle that I was posting first thing tomorrow to the court and VCS. They needed to be submitted by the 14th in which VCS would have had to pay there court fee by, with the hearing on the 12th September.

I walk through the door and open some very welcome post notifying me they have discontinued the claim, with a copy of what they have sent to the court also.

Not really sure what prompted this but happy days :)

Worth double checking with the court? Although there phone lines are so busy and taking ages to reply to emails

Can I still look at claiming any costs for my time and printing materials?

Thanks for all the support previously!

Keep that letter safe, and check with the court/MCOL in a few days time.

Well done. Another one bites the dust.
