Help please asap

So a NCP parking charge notice came through the post. There is a photo of the vehicle entering at a time and leaving at a time. The person who was driving ran in to pick up some tacos which took 25 minutes and there was no other vehicles in the car park and now NCP are charging £60/£100. Does anyone have any advice to deal with this ridiculously high invoice? All help will be appreciated i have read the newbies but I was not sure how to word the response if anyone could type out for my a reply to send to NCP would be great. Thanks

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.

    If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

    Yes, I've just checked and that is the text written in blue, so is fine so long as you didn't make any alterations to it.

    But don't be under any illusion that the template appeal (or any initial appeal) will achieve a cancellation, it is just the first step in dealing with the charge.  Much more will need to be done, so continue learning the ropes by reading other threads as well as the NEWBIES FAQ sticky.  The more you know, the better you'll deal with this, the greater the chance of success. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    Huge confession: I've never had a taco.  

    I assume they're quite cheap though ... is that so?  If so, paying to park sort of defeats the object.  More importantly, perhaps you anticipated quicker service?

    What I'm doing is musing about the content of the landowner complaint which you absolutely must send ASAP.  Firstly, confirm if the Taco place is the landowner or whether there is an overall landowner / land management company for the car park & that area.  Perhaps the takeaway will tell you - just ask - but if not, then google the retail park or whatever it is to see if the landowner is identified somewhere.

    The main thing to complain about is the fact that even though occupants of the car were genuine customers, you have been landed with a hefty invoice.  I assume that occupants of the car will not be buying any more tacos if they come with a £100 surcharge(?). If you (plural) have been regular customers, mention that too and ideally estimate how much has been spent there over a given period.  Use the phrase 'genuine customers', refer to your frustration at realising that, apparently, there is a need to pay for parking in order to buy an economical meal.  If signage is far from obvious in the car park, mention that.  Be basically polite but be firm and insist on cancellation.

    Do the complaint in addition to the first appeal.
