  • UPDATE:

    It's been over a year since I received the PCN and have received five letters from Debt Recovery Plus (each more 'threatening' than the last). I contacted DRP and contested the PCN after receipt of the first letter and have ignored all others. Last week I received a 'Letter to Claim' from Gladstones Solicitors seeking payment. I have contested the PCN with GS as well.
    It's my understanding that a Letter to Claim is a mandatory correspondence before a claim can be made against me, though it doesn't mean that a claim will be made.

    If a court claim is made against me - what is my next move? As mentioned in my original post, I have video evidence that my permit was on display and witness evidence albeit my partner. Do I need to present my case in a specific manner? What kind of evidence can I present in court? Can I request the claimant to provide additional information, e.g. at what times of day the parking space is monitored?

    Any help appreciated.

    Please don't think this will or might go away. You will be getting a court claim fairly soon, so start doing your research now as already advised by Coupon-mad.

    Get pics of the site and signage, covid regs permitting.

    Send an SAR to the DPO of the scammers as per the NEWBIES.

  • @Coupon-mad Thanks. I've now read the newbies post 2 regarding LBC and have submitted an SAR to CPM and have contacted Gladstones stating so.

    @Fruitcake I never received a response from the landowner / property management company.  I don't expect this will go away... I'm just trying to ready myself for what's next. I'm going to fight this cause it's just wrong.

    If you want to know what comes next , it's court , where you defend yourself. The newbies FAQ sticky thread has a link to a post telling you what happens and when

    Evidence comes just before the hearing in several months time along with your witness statement etc

    Pics and videos and documents can all be used

    Why not read every residential court claim thread with CPM , pcm , link , VCS etc over the last 12 months to see how it progressed and learn the basics , it's your main job to do this research , or hire a lawyer to do it for you , at great expense !!

    Once you get with the program , you get facts , opinions and suggestions

    You can fully expect a court claim before easter

  • @nosferatu1001 I was busy with life.  I have today again contacted them asking them for information regarding the parking policy.
