“Illegal” action by DWP

Is it true DWP can reclaim any “overpaid” tax credits by a direct earnings attachment without having to prove it has been overpaid?

Comments

  • Did you challenge the decision? Did you challenge recoverability of alleged overpayment? I believe HMRC are supposed to suspend recovery of tax credits overpayments pending the outcome of a challenge, but am open to correction.

Only if HMRC have asked them too.

    Completely inaccurate thread title.
    Isn't "illegal" at all.
You not liking or agreeing to something doesn't make that act "illegal".
