I agree that appealing is a risk with no certainty of the outcome.
On the other side of the argument not all judges will take the same view. The DDJ's can be operating in very different aspects of the law.
What does annoy me is that the principle of small claims is to keep down the costs for both parties.
When the defendant puts in a claim for costs they are lucky to get anything for stationary and postage and yet these ruthless PPC's are getting away with adding on £60.00 which they are not justifying.
Most of the time the debt collector is working on a no collection no fee basis. If the PPC's are sending out letters it does not cost £60.00 to send out a few standard letters.
Hopefully things will soon change for the better.
