  • Is it a new build?( Well fairly new.) Does it have onerous terms for the leasehold? Or the ground rent will increase exponentially?

    Buyer is under no obligation to pass on info. However as I have no interest in now buying that house i would gladly sell it for £20 if it was me

    That would be an interesting phone call. Maybe something like this:
    "The mortgage company told me why they won't lend on the property, but I'm not telling you unless you send me £20.

    I'll phone you back when the £20 note arrives in the post."

    That's lawyer stuff, rather than anything the surveyor would be finding out by themselves.
  • Nothing stops you from sharing it with anyone you want. No third party can rely on the report without the lender agreeing to it (a** covering).

    This is the T&C that you are referring to.

    "No responsibility whatsoever is accepted by us to any third party and this report should not be relied on by any third party for any commercial purposes or any use without our written authority."

    I agree that if one is the sort of person who divulges confidential documentation then there is nothing anyone can do.

    I was under the impression that the survey was likely to state in its terms and conditions that it was not to be copied and/or shared.
    If this is the case than the buyer is quite correct in their actions

    I agree that if one is the sort of person who divulges confidential documentation then there is nothing anyone can do.
    My wording was lifted verbatim from a (I can't recall exactly which of the two) Barclays/Halifax valuation (which is the subject of the OP) and would remain unchanged whether it is contracted out to surveyor X or Y or Atlas Surveyors.
  • When I tried to re-mortgage my house after its fixed terms i wanted to switch lenders to take them up on one of the many offers available. 
    My Flat was deemed um-mortgagable due to its being in a block that was mainly council owned and the "low demand" for properties like mine in the current market.
    Both of these are utter tosh as there is a huge demand for them.
    Just in case its something like this.
