Letter from DWP interview under caution

A bit of guidance for sassy-one.
"Scoring points when your condition varies.
Your condition is assessed as it is likely to be over the course of 12 months. The descriptor that applies to you for any given activity is the one that is correct for the majority of the time. However, deciding which descriptor applies can be complicated – much more so than for ESA, for example - as there are a number of factors which must be taken into account. This includes whether a descriptor applies even for a small part of the day and whether two or more points scoring descriptors should be combined to decide if you score points on the majority of days.
At any point during the day according to law a descriptor applies to you for the whole day if it applies at any point during a 24 hour period – unless it is just "momentary". So if, for example, the painkillers that you take first thing in the morning work straight away and allow you to wash and dress, etc., without delay, that would not count. But if, as in practice with most painkillers, you have to wait a disruptive amount of time for the painkillers to take effect, you may score points. Guidance issued by the DWP clarifies this by explaining that: ‘If a descriptor applies at any point during a 24 hour period, it is considered to apply for the entire day, whereas in DLA it would have to apply for ‘the majority of the day’ in order to apply.’

I finding the way this new forum presents quotes very confusing when trying to work out who’s said what!Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0

I'd suggest you read the descriptiors of PIP, you'll soon see how I come to that finding.
I think the only person that needs to read them is yourself.

I don't know how to multi-quote yet, but sassy-one I suggest you take heed and brush up on PIP criteria and how it's assessed. I'm not sure how cleaning the car or putting the bins out requires reliably and repeatedly being able to walk more than 20m or 50m; even going to the skip or taking people to swimming! Besides, we don't know yet which rate or for which descriptors OP is claiming the mobility element anyway.4 -
It wasnt for consecutive days. They said they filmed me throughout july and only presented an hours worth of video footage, over 4 random days. On a particular day 20 mins of the video is me talking to my best friend, whilst I supported myself by resting on the car.
I filled out the PIP Form in January 2017. At that time i had just suffered a nervous breakdown. The video took place July 2019. (2 and a half years later) and as I say I'm hardly doing anything in the video. I take strong pain killers issues by my doctor on repeated prescription. I take them regularly, I take them first thing in the morning, all recordings had the time and date and was always around lunch time till about 2pm.
The footage doesnt show that I have to go to bed at 6PM every night with the pain I struggle with. My doctor tells me to go swimming, a portion of the video is of me swimming.
I will say again its Personal Independence Payment, to live independently. I have never lied on any form, everything I put was for a true reflection on what I go through. My medical records speak for themselves, it's something I cant lie about (mri results, trays, tests etc)
I have had 5 days to dwell over the interview and I will be issuing a complaint as to why I was taken in for these rediculous questioning.1 -
