PCM Notice to Keeper

Good afternoon,
my partner received a Notice to Keeper from Parking Control Management (UK) Ltd. by post.
The alleged offence is "Parked within a restricted area" and the photos show the car on double yellow lines at the new residential development.
However...
1) The photos were taken within a range of 17 sec;
2) The driver is visible in the driver's seat;
3) It appears that the situation in the street/car position changed slightly between the photos.
Considering the notoriety of PCM, we would appreciate any advice on dealing with them before submitting a short appeal below.

I dispute your 'parking charge', as the keeper of the vehicle, on the grounds that the contravention “Parked within a restricted area” did not occur.
The photo evidence taken within 17 sec range shows the driver in the driver’s seat of the aforementioned car, therefore the car was not parked or abandoned for any period of time but was filmed while being driven.
The traffic warden obviously noticed the driver and that the car was not stalled as no ticket was placed on the car itself.

If not then it may take primacy over the self serving TnC of the scammer, and interfere with your lawful right to “quiet enjoyment” of your property, possible an offence under The Landlord and Tenants Acts.[/FONT]
[FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Send the appeal template in blue from the NEWBIES like you did for your Highview PCN.
You could add a one liner that their evidence shows the vehicle was still moving so there was no parking event and the scammers have therefore obtained your personal data from the DVLA without reason.
Complain to the DVLA about the last part.
Complain to the landowner and your MP about this unregulated scam.

The query was not whether the photos were taken by a human, but whether they were taken by a traffic warden who are now called Civil Enforcement Officers (CEOs) and only operate on public and council owned land.
If the alleged event occurred on private land then the pic's were not taken by a CEO.I married my cousin. I had to...I don't have a sister.

It is not the development where she lives but it is where the school is. She might be picking up the kid from school (which is allowed on double yellow) but never left the car and the photos confirm this.

Is it DYL on a public road or in a car park. You are right that it is OK to load/unload on DYL's provided there are no kerb blips on a public road. DYLs in a car park mean whatever the PPC want them to mean!0

It is a public road without any special markings in addition to DYL.0

PCM UK ltd cannot operate on a public road , so it's either private or they are breaking the law
Only council operatives can do CEO work on a public road
Why do you believe it's a public road ? Has the council confirmed it ??

There are no signs for the private road, however parking in the whole development is managed by PCM. After your response I'm keen to research further regarding the status of the road and PCM authority.0
