LCW Mandatory Reconsideration

Hello i’m currently doing my Mandatory Reconsideration for LCW to get LCWRA. I dont have any new evidence but am disagreeing with things in the report.
I have a counselling appointment this week so it will be after ive sent my MR. If they can write a letter or provide more evidence, is there any way to add that to the MR once ive already sent it? Tia

    I wouldn't concentrate too much on the things you disagree with in that report. What you need to to is concentrate on the reasons why you should be given LCWRA because this is what they will be looking at.


    Yes, you can send evidence once the MR letter has been sent but whether it will get there before a decision's made is a different story.

    I was placed in to the WRAG and disagreed with many factors that were put on my report. My son called to make a mandatory reconsideration and explained everything that he disagreed with in the report. Everything was done over the phone, and I was awarded support group. My son was present throughout the interview so was able to put right everything that was incorrect on the report.

    This is an interesting issue. Completely agree that the main thing is to explain why claimant meets the criteria. Also completely agree that at appeal stage time spent on highlighting report errors is largely unnecessary because tribunal judges know how bad they are and it is their role to establish the facts for themselves.

    However at MR stage it is still the DWP making the decision and, although the report is supposed to be only one piece of evidence, we know they generally follow the report recommendations. In principle therefore it is helpful to highlight factual errors in the report - hopefully it might help prompt the DM to look at the bigger body of evidence. Nonetheless I agree it shouldn’t usually be the primary focus of the MR - although post by Jab87 indicates that it can be enough.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.
