Claim defence stopping in no stopping zone at airport

Hi everyone and thanks for all the great information that is posted on here as it has helped greatly with the issue I am facing so far.

To cut a long story short, I am now at the stage of writing a defence against a claim of £185 (£160 + £25 court fees) for stopping in a no stopping zone at an airport. If possible I would like some guidance as to the the stages of the process you feel I should take or anything more I should do that has not been done already.

I have replied to the claim stating I will be making a defence. I have also made a CPR 31.14 to the PPC.

I have read many posts regarding successful defences against other court claims from PPCs but would be interested to know what points should be covered in a defence of this kind.

Points to note which could be used in a defence:

The registered keeper which all correspondences have been made to was not the driver at the time of the incident and the PPC do not know who the driver is.

The airport in question is governed by Byelaws which clearly cover the no stopping zone which is subject to a £100 penalty, the PPC do not have legal authority to enforce.

As the airport is governed by Byelaws, they do not have reasonable cause to access the registered keeper information through the DVLA.

The PPC is claiming £160 when the original claim was £100. Artificial costs incurred adding £60 to the original PCN of £100


So this is a far as I have got and would be greatly appreciative of any useful you may have regarding the issue or for any defence posts of similar circumstances.

    It'd be also useful if you told us which airport, as the approach taken can vary depending on which one it is.

    Irrelevant ... the PPC can't pursue the registered keeper as only the driver can be liable for a bylaws offence.

    I agree with you, BUT if the driver hadn't stopped in a no stopping zone surely that would also form part of the defence as well ?

    If they did, then in the future, following simple instructions will avoid a whole lot of hassle whether you are technically in the right or not

    A vehicle in front could stop, forcing the vehicle behind to stop. Have the drivers of both vehicles committed a No Stopping offence? ;)
