    Now does this mean, as I am an occupier of a dwelling, but was parked in a space which wasnt my own, as my space was taken, that overrides the ‘contractual agreement’ set out by the private parking firm? The car park can only be accessed with a passcode also

    And no, they will still claim you should have magically parked elsewhere. This is why this is a scam - the person parking in your spot gets charged, and so do you, yet you gain nothing out of the arrangement. They dont prevent the person parking, they dont move them on, nothing.

    We have told you the legal position. Further questions can only be decided by a judge. You need to take ownership of this, these companies can get nasty.

    That reads to me, that every resident & visitor is allowed to use any space.

    Thanks for the reply. I’ve sent an SAR to the PCN company and a templated email to BWlegal requested all information on the case. Now do I wait until I get a reply? What are the chances the fine against me will be dropped before court? Is there anything else I can use in my defence to strengthen my case. Especially in terms of lack of signage. The signs state ‘authorised parking only’ nothing about parking in specific bays. How can I word this to my advantage?
