I agree with your view on this calcotti. It is securing the home and I have not come across any case, where a Decision Maker has decided that it is somehow an adverse issue for DWP. Arguably makes it less likely home is repossessed and therefore Housing for rent would be required. Also any eligible support for mortgage (SMI) interest loan would be reduced.
Caveat: each case on its own merits, as it will depend on individual circumstances.
My opinion is stronger than this. Under UC I do not believe the DM has any discretion on paying off debt. The law expressly states that paying off debt is not deprivation of capital and I cannot see how a mortgage can be considered anything other than debt.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.0 -
Many thanks Calcotti & huckster, it does sound as though this proposal may be feasible (as long as me keeping all the equity works out as an appropriate division of our assets - my husband keeps insisting he doesn’t want the equity & it should benefit the children but we’ll see what the solicitors say).
