Yes, data can be passed on in accordance with the usages set out in the privacy policy.

The fees will be the same as in the original contract.
  • It just seems odd that we have not had any correspondance from this firm , at all,,,

Not really. Once a customer has agreed to hand over a chunk of their money, a CMC doesn't need to do anything more except wait.

Contacting people is just viewed as unnecessary work.
  • Thank you , so basically we just have to wait to find out who this company is and what they want
  • Pretty much yes. They will be as keen to get their share as they were to put the stamp on the envelope in the first place.

Make sure you check this carefully for the fees charged. I've just battled against a company who got my nan ppi back but never signed a contract. After me putting on a complaint to them and the ombudsman they've replied to us to say her account is closed and she owes no money.

I don't see how a company can go busy and another just receive all your personal details. Have you got a copy of the original contract?

If your gas company goes bust they can't just pass on your details.etc to another company without your consent.
  • I don’t have any copies of any thing , so surely before i pay anything they can provide me with a copy of what i have signed with the original company ,,,,, this has been passed on from a Company i believe lost their licence, and been passed on again ,,, so thus is the third company from the original one ??

Write to them and ask them for proof that they can complain on your behalf.
If they truly do have the authority to do that, they should have no trouble supplying it to you.

  • Thank you , i apologise for my lack of info ,,, but i actually don’t have any , all i have is a covering letter and a cheque from blachorse,,,, on the covering letter is a correspondance ref to a firm called goldman knightlyl ,,, and thats it , i have no copy of any contract of the original company ,,, let alone the second ,,,, or this one whoever they are ,,,,, so will they provide with a copy of the original ,,, what if they can’t what do i do
  • You say you have a cheque from Blackhorse - I take it this is the ppi refund.

If that's correct, cash it and keep back a percentage of it to cover any claims from a claims company. I think the max they can claim is 20% plus vat - might be wrong on that though.

Sit back and wait for the demands for money and as stated above write to them for proof of contract and see what transpires from that.
