If ANPR scameras were used then the NTK must arrive by day 14, the date of the alleged event being day zero.
In your case the date of posting was day 15 and assumed delivered on day 17.

This is explained in the PoFA linked from the NEWBIES and I believe also explained in the NEWBIES.

There is no such thing as a registered owner. It is important to get these things right.

Send the appeal template in blue text from post 1 of the NEWBIES from the keeper, unaltered except a one liner if you wish saying the NTK was given (received) too late for keeper liability to apply.

Do not reveal the driver's identity under any circumstances.

What happened when you complained to the landowner?

Have you complained to your MP yet about this unregulated scam?

Thanks for the reply mate, I have not contacted any one as yet. I wasn't sure if I received the PCN after the 14 day deadline. Once again thanks for clearing that up, I will get the template now and appeal against the PCN.

How does 14 days matter, given we know Smart don't word it as per the POFA?

It is one of the easiest to cancel just by telling them you know they are non POFA! This is in all other Smart Parking threads already with suggested wording to edit the appeal template to suit.

Please don't ask us to check it, no need. Smart have NEVER used the POFA.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for the reply again mate but if 14 days reason doesn't matter then on what basis should I appeal?

Please read again Fruitcake's response above - post #2 on your thread.

He explained on Friday exactly what you should do.

Read what Pete Wishart MP said recently in the House of commons about Smart Parking.

"I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.

The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices."

Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

What she means is that it wouldn't have mattered if the NTK had arrived by day 14 as the wording in Not-so-Smart's NTKs are non PoFA compliant.

Just send the appeal template with the one liner added.

Do make the complaints. It doesn't matter whether the NTK had been PoFA compliant or not; it's still a scam and needs reporting.

If the appeal is rejected then read up on how to win at PoPLA as per post 3 of the NEWBIES.

How does the 14 days matter? It doesn't! Why do posters not see this?!

• Update:
Driver told me that they did bought the parking ticket but they can't find the ticket so I didn't wanted to appeal on those basis. However since receiving the first PCN I have received another PCN from smart parking for the same car park but different date. But this time driver found the parking ticket they paid on the day so I have got proof. I have got 2 questions now:
1) How should I proceed now with 2nd PCN, I have already appealed first PCN.
2) Is it possible to get the log from ticket machine for the date when they issued first PCN as driver assured me they did paid before leaving.
Thanks in advance.
