implications of son on a tenancy agreement

We are currently looking for a new rental after 13 yrs in the same house, the owners are now selling. However we have some issues. In order to be able to rent , our household needs to earn 52000 to be able to rent in our area. To reach this amount we need to put my son and his girlfriend on the tenancy as they wont take carers allowance into account.

On our current housing benefit claim my son and his girlfriend are down as non dependants and we get deducted the full amount for them, if they were to be put on the tenancy do housing then consider them to be joint tenants and expect them to pay half the rent or would they still be counted as non dependants, as they certainly couldnt afford it.

And is there any implications for us not declaring HB to a new landlord, our current landlord is fully aware of our circumstances and we found him by chance and most landlords dont accept it , even though we only get a little bit as my husband works as well

    As joint tenants, then yes they would be expected to pay their share of the rent if you put in a claim to benefits to help pay your rent.

    Are they claiming benefits? If not it doesn’t matter to them what they would be expected to pay.

    On your claim you will only get help with half the rent (subject to the Local Housing Allowance) but you can choose to pay more if you can afford it. There would be no non-dependant deductions for them.
    Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

    so basically unless I find a landlord that accepts housing benefit I cant get a house and will have to force my landlord to take me to court to declare myself homeless and hope the council find something so everyone can get to work and school as well as dealing with a housefull of stuff and a service dog. sounds like Im doomed

    squizz11, you mention that you receive Carers Allowance. Who are you caring for? If it is your partner I presume he/she is receiving either the Daily Living Component of PIP or the Care Component of DLA (as was). If so, there shouldn't be any non-dependent deductions in respect of your son and his wife, regardless of what their income is.

    From other threads it seems it is one of their sons, not the partner.
