Gladstones - Letter before claim

Hi


I received a Letter before Claim just after Christmas from Gladstones. This relates to a PCN regarding not being parked within a marked bay and recovering losses for their client, NE Parking. I did not get the chance to appeal before the matter was passed to a debt recovery company, but they did send me some pictures as their evidence.


I have read the Newbies post up to a certain point. I have submitted a SAR to the parking company and have also written a letter to Gladstones seeking a delay in processing of data whilst seeking debt advice. This was approximately a week later than the 30 day timescale they provided.


I guess now I wait to receive the actual court papers?


I am so incredibly nervous and anxious about this, that it is affecting my clarity in thought and I no longer have rational conclusions and ideas. It is exceptionally difficult navigating from a hand held device (forced to do most of the time).
Any advice on what I can do now to prepare would be greatly appreciated.

    below is an example of charges ...



    £100 - original parking charge
    £25 - court filing fee
    £25 - hearing fee, if it gets that far
    £7 or £8 interest.
    £50 - solicitor costs for preparing case papers (maximum, capped) - where applicable

    So not much more than £200 - IF YOU LOSE!

    Anything else they try to add will be spurious and must be challenged with the Judge.

    IF YOU WIN - none of the above will be payable by you. But you could claim:

    £95 capped maximum for loss of earnings/annual leave for half a day (take pay slips for proof)
    Travel costs - public transport or mileage x 45p per mile
    Parking costs.

    If the PPC has been wholly unreasonable in dealing with the court, then costs awarded against them could be considerably more, but the bar is set very high. We would advise nearer the time if we think this is worth you pursuing.

    Some judges will throw the case out if they overclaiming.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    A trip to the library to use a PC. There is so much to read, so many notes to take it will save your sanity

  • The first piece of correspondence I have is from a debt recovery agent for £160. When I spoke with them I seem to recall the original charge was much lower. I don't recall receiving the original PCN and called the debt agent to retrieve the PCN (that I still never received, just the photographs they relied upon).

    You cannot possibly do this on a phone. This is indeed what libraries, or friends/family with a laptop, are for.
