Part Exchange v5 advice
I recently bought a new car and traded in my old car part exchange. I thought I had the v5 with me but it turned out I had the wrong part of the document.
By this point the sales man had already processed the sale and told me to swap my insurance over before he checked my documents.
He allowed me to take the new car away as long as I agreed to bring in the v5 once I had received it. I ordered a new one but I’m having trouble getting this as I hadn’t previously changed the address so it was being delivered to my parents old address and I have been unable to get hold of it. The salesman was aware of the situation with this.
I’m now getting phone calls and emails every single day to the point that the sales man has even suggested he will come to my house to collect the v5.
I looked on the DVLA website and can see that you don’t need the v5 to exchange ownership of the car..
Where do I stand with this as they are now saying I will have to pay them the value of the part exchange..

So have you responded to the calls and emails to keep him updated?
Your can let them apply for the logbook and you cover the 25quid fee or apply for a new one and pay dvsa yourself0 -
you HAVE NOT concluded your part of the deal as agreed so I can understand why the salesman may be annoyed.
He is maybe getting it in the neck from his boss for trusting you to be good to your word, perhaps his company's policy is NOT TO BUY without V5.
Conclude your part of the deal and provide what you promised.
You are blaming him for your errors and mis administration.0 -
What did you take in? The V5C is a single double-page-spread A4 document. Some parts are removable, but you wouldn't remove them until you came to dispose of the car.I recently bought a new car and traded in my old car part exchange. How are you trying to get hold of a replacement? You need to use a V62, and you can change the address on that - you simply put your current address in the "current address" field on the form. Have you tried to contact the occupants of the old property? He allowed me to take the new car away as long as I agreed to bring in the v5 once I had received it. No, because the V5C has nothing to do with ownership. But it does have everything to do with who is the person legally responsible for the car. Without it, they would have to register the car in their name, and pay for the V62 themselves. And that's assuming there wasn't an issue preventing a V5C being issued.I looked on the DVLA website and can see that you don’t need the v5 to exchange ownership of the car.
They've dropped the ball allowing it to get as far as they did before discovering your failure in basic administration - but that doesn't mean they can't say "Well, hold on. We don't want your old car without the V5C - sort it out."
But you would, presumably, then get that car back... They can't keep car and money, but they can say "We don't want your old car without the V5C - provide it, or that part of the deal gets unwound".Where do I stand with this as they are now saying I will have to pay them the value of the part exchange..
How long has this been dragging on?0 -
I had already ordered a new copy but it was going to my parents old address and I have been unable to retrieve it.
I completely understand his frustration, is the best option at this point to suggest me ordering it and changing the address even though this will take 6 weeks?
Thank you0 -
Why didn't you let the DVLA know about a change of address? Many people have had fines escalated and transferred to debt collection agencies in circumstances like this.
What about your insurers? Do they know your new address and that the car is not registered at the same address? What seems like a minor admin error can have serious consequences as you are finding out.Signature on holiday for two weeks0 -
I'm not surprised. They can't sell it on without a V5, so your lack of providing the V5 is costing them money....
I’m now getting phone calls and emails every single day to the point that the sales man has even suggested he will come to my house to collect the v5. ...
Where do I stand with this as they are now saying I will have to pay them the value of the part exchange..
You seem to think that they are the ones being unreasonable!0
