Debt CCJ

Hi all..
10 years ago i had to default on my credit card debts...under CAB advice...i received default notices and CCJs.....we set up a £1 a month which was accepted by all creditors through CAB.... so 6 years of realy bad credit ect has done me no favours and now 10 years on.....they have started court proceedings for the same debts and issuin ccjs again.....im back at CAB but im still in severe hardship is it right that creditors can keep issuing court claims and ccjs for debt that has already been done?.....
Im still paying the £1 as agreed and tealy am at my witts end

    Debts only default once, and court action is limited to one judgement per debt, so something is wrong here.

    What your suggesting is not really possible, as you would defend the claim on the basis that action had already been taken.

    You need to clarify who took you to court previously, and who is doing so now, and for what accounts, more information is needed.

    A CCJ can be extended in certain, limited, circumstances.
  • Yes the exact same creditor arrow global ltd and now drysdale fairfax solicitors....the same amount except added court fees....showed CAB and they said to admitt debt
  • Mbna was the original debt

    You really have to provide details, otherwise it’s just guesswork, when was judgement first entered, did you defend the claim ?
    What state is action at now, have you received another claim form, have you defended it, are you defending it ?

    Court action can’t be taken twice on the same debt, but the original judgement can be further enforced, but not after ten years.

    The more you can list events in time/date order, providing as much detail as possible the better we can help you.

  • Court claim pack arrived last week for the same amount as in 2010...but they have added a further 280 for costs....
    CAB said not to fight it but accept the full amount as i have a repayment in place set up....
    The paperwork has been sent back to the claimant not the court....
    If i defaulted in 2009 and a CCJ was served... im struggling to comprehend why after 10 years its being aent back to court, and CAB appear not to be concerned?
    I have maintained the agreement of a £1 a month for last 10years and have received statements but it just seems to be getting to complica:)

    They can’t take you to court twice for the same debt, period.

    You need legal advice on this, post on the Legal Beagles website, they will advise the exact procedure you must follow in order to sort this out.
