NatWest pulling new build mortgage due to no NHBC certificate before completion

Ok so to say we are around the bend is an understatement.
Our solicitor refused to let us exchange contracts with persimmon saying they do not provide the NHBC certificate before completion and our mortgage provider (NatWest) would refuse to release funds without it.
Many other purchasers on the estate have used NatWest with no issues, so our solicitor writes to NatWest explaining the situation and they have come straight back within an hour saying if we don’t have the certificate before completion which persimmon are saying they don’t do then they will pull our mortgage 😢 how is this possible when no one else has had any issues ? Our mortgage broker is off today and NatWest are refusing to speak to us directly.

What is your source that other purchases on the development are using NatWest? It's possible that their T&C is that they "might" or "have the right to" refuse to release the funds without NHBC certificate and it's a case where they didn't exercise that right with the others.
In any case if you have a statement from NatWest that they don't release funds without certificate, and Persimmon are not providing it, you have two choices
- Find a new property that does issue certificate in time.
- Find a new lender that doesn't require the certificate.0 -
I’ve spoken to others who have recently completed who have had no issues our mortgage broker has never come across this issue before arranging many NatWest mortgages for this same development, I suppose what I’m wanting to know is has anyone managed to resolve this situation before without choosing a different home or changing mortgage providers neither of which we are willing to do at this stage0

Maybe the solicitor isn't sure what CML certificate is, as this is all that is needed before you exchange contracts.0

NatWest have said they will pull the offer if we don’t have a building regulations completion certificate by date of completion which persimmon say they send out after completion. We are using premier property lawyers and I’m really starting to wish we had used the solicitor persimmon advised like everyone else on the estate who has had no issues did0

As you said that other people in the development are using Natwest with no issues, try to get a written consent from them for their details to be used in your complaint agains the Natwest and then make a formal complaint to Natwest asking why they specifically descriminate against you.0

Speak to someone else in Persimmon, the surveyor will issue the CML certificate on the day they inspect, unless this site uses the local building control authority to sign off their properties.
I think they maybe getting what is required confused, usually the developer will issue the NHBC warranty or guarantee after completion, CML is usually issued by someone else other than NHBC.0 -

Yes, I think the terminology has been lost in translation when communicating with solicitors, underwriters and developers.
No lender in the land will release funds on a new build without it being signed of by either NHBC or CML from an appropriate surveyor.0 -
Spoke to persimmon who have said the property is inspected 2 weeks before completion and signed off then we receive the warranty after completion I’m really getting to the point where I’m unsure if my solicitor has a clue what he is doing.0

I think Persimmon need to check what their staff are saying to their customers. Find out the name of the person you have spoken to, then call head office and ask to speak to him manager and ask them why they cannot release the CML certificate until after completion, as no lender in the land will agree to release finds if they havent seen CML certificate.0
