Offer accepted pending missives Scotland

Hi

We are first time buyers and have been looking at houses for the last 6 months with no success. We viewed a house previously that we liked and we were now thinking of putting in an offer but noticed yesterday that it says on property ad offer accepted pending missives. Can we still put in an offer ?

Not really. You can tell the agents you'd be interested if the current offer fell through for any reason, but it's not that likely to happen.
  • Thanks. That’s what I will do. A bit disappointed in myself in being so slow with this one but maybe it’s not meant to be.

In the future make sure you put in “a note of interest” this will ensure that no offers will be accepted without giving you a chance to offer. Most likely through a closing date once someone wants to make an offer.
  • Does the note of interest have to be done through our solicitor or can we do it ourselves verbally?

I believe it has to be done through your solicitor. The same as any real offers. An offer to an estate agent (in Scotland) is just to see if the seller will verbally agree to the price. The offer then has to go through the solicitor to be formally accepted.
  • Thank you both for your advice

It has no legal status, it's merely a courtesy between solicitors and their clients.

You could state your interest personally to the seller's agents, but all that would suggest is that you don't have your solicitor in place, and therefore you're not ready to proceed; so why should they let you know of any closing date, when you're not in a position to offer?
