Virgin Holiday - ABTA

Guys! Need some advice with this!!!!

Basically we recieved a call from Virgin yesterday saying that they had a system error and that the holiday we booked back in July doesnt have the availability for us. They have given us 2 options. Free cancellation or for us to pay £1600 towards a new resort!!

They have said there is nothing they can do so we need to go to ABTA.
We emailed our complaint to abta today, with the resolution that Virgin pay the £1600 they are asking us to pay. Has anyone ever had anything similar to this? And if so what came of it???

    What does your contract say about them being able to cancel?
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Exactly ... if the OP would have been charged a cancellation fee (if they cancelled within the same time frame) then any equivalent charge could be sought by the OP as damages due to the seller cancelling.

    IMHO it would be in Virgin's best interests to absorb all (or at lease most) of the additional price for the alternative accommodation. After all, if the price to the consumer is £1,600 then the cost to Virgin is likely nowhere near that.

    This is why I wondered what it said about cancellation.

    If the OP would have had to pay to cancel at this stage, then virgin cannot get out of the contract without similar consequences.
