Paid CPM same day - asking for more money!

Hi guys,

I've read all the newbie threads and a few others but still wondering if anyone can help me put this debacle to bed!

I got a PCN on from CPM UK Car Park Management back in July. I was parked in a resident's garage without a permit on display (a friend had said I could borrow his space and gave me his key fob to get in - didn't realise I'd need a permit). Got the PCN, realised i was in the wrong and freaked out (didn't have a spare £60 and no grounds to appeal).

The other friend i was staying with could see i was on the verge of tears so logged on to paymyticket.co.uk and paid the £60 same day (photo of my car on there),

I got a letter a month later saying I'd not paid and that they now wanted £100. Not happy I attached my friend's bank statement to their online appeals form and said "Go away, I've paid'. I checked the status a few weeks later and it still said unpaid. So i called them, they said they hadn't got my evidence (convenient), So I sent it again...

Fast forward to today and I now have a letter from Trace Debt Recovery after £160! I have no intention of paying this and their threat of a CCJ is crap (surely I'd win in court?!).

I've since sent CPM an email and attached my evidence of payment - am also going to print and second it and get proof of postage.

Looking for any advice I can get from you wonderful lot!

First bit of advice never ever pay a parking charge notice form a private company, your friend more than likely has a right to use that space in his/her lease/rental/whatever agreement and no third party such as a parking company can take that away by means of a permit or any other restriction.

You were given authority to use that space and were parked with permission.

Has the money you paid under false pretences been taken by CPM UK?

Proof of postage should be no more than obtaining a free certificate of posting form the post office never ever use recorded or signed for when dealing with aPPC.
You should demand that they cease processing your personal data as they have no need to retain it as the matter was settled.

Unfortunately its not quite as crap as you think.
first they would have to take you to court, and then and only if you do not pay then you will get a CCJ.

When they do issue court papers, you can add a counter claim for a breach of GDPR and recover your costs and what you paid them in the first place.

Let them take you to court. From what you have told us they would surely lose, and you might even win a counter claim for harassment/breach of your personal data.

Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.
You never know how far you can go until you go too far.
  • Half_way - thanks for your reply

You're right, I probably should have challenged it but I was going through a stressful enough time and just wanted it done and dusted ASAP...

Yep, it cleared her account on 16th July. So we're feeling a bit robbed to be honest.

I had read that about posting, so thanks for clarifying :) Oo yes, I'd also read that so I'll put that in there also.

Aye yep, though their letter suggests that you just get one (shady scammers!) Thankfully I'm prepared to go and defend this nonsense. Just really hoping it doesn't get that far. Thanks again for the advice on GDPR and thanks for your time!

    Thanks, I will!
