Yes, they use Hitachi. I looked in detail at the T&Cs and data "privacy" policy. A significant part of the latter is ambiguous when it comes to credit reference agencies, but the gist of it is that they'll search files if credit is being requested. In the current case credit was not requested, so they had no business searching files. Even if their T&Cs allowed them to credit check for non-credit matters then the T&Cs would probably be considered unfair by the financial regulators.


I worked through the order process on the Tempur website as a customer not requiring credit. There was no requirement to enter a date of birth for this type of order. So, how do they access credit reference files without one? The OP should raise this singular point with the ICO.
