Ashton Moss Parking Charge - WIN

I just wanted to say I originally decided to appeal my parking charge by U.K. PC at Ashton Moss retail park because I searched these keywords and stumbled on posts from this forum and found that a few people had won their POPLA appeals dating back to 2013 on the grounds their were insufficient evidence that they have permission to authorise ticket on behalf of the landowner I did use a Facebook group and had someone appeal on my behalf however I have won due to the same reasons that I’ll post below , Im just hoping this thread will reach out to other people searching 2019/20 onwards like I did that you can hopefully win the appeal and just wanted to do my part within the community that is helping people fight back against these scum :p

“The operator has provided me with evidence of an Agreement for the supply of Parking Services document, which shows the terms set by the operator and that they are authorised to manage these terms on the landowner’s behalf. However, the documents provided do not include any signatures or designated points of contact, who has authorised the agreement. Whilst I appreciate that there is information blacked out on the form, I would expect the operator to provide with at least details of a point of contact or a signature, indicating the authority. As such, I cannot determine if this meets the requirements set out in the BPA Code of Practice, and if the appellant was parked on the operator’s land. As I cannot establish that the operator has sufficient authority, I cannot confirm that the PCN has been issued correctly. I have not considered any other grounds for appeal, as they do not have any bearing on my decision. Accordingly, I must allow this appeal.

    good research usually wins in these cases, and I see it did at POPLA for you


    beware of the one at the Peel Centre and always keep the paid for receipt because people are being short changed in time , with pcn,s for being over an hour when they have paid for two hours

    Proving once again that the BPA reply on scammers for their income.

    I cannot determine if this meets the requirements set out in the BPA Code of Practice

    If the BPA acted as professionals, this would never happen.
    Despite the BPA saying about all the checks they do, they are still living in the clouds
