    I am not clear why the LPA is not registered given the circumstances. The 31 January deadline is not important because she was recently widowed so a reasonable excuse claim can be made later. What kind of US visa did she have when she lived in the States?


    The LPA is registered, but as she still has her functions it's not in force.


    I'm not sure about what type of Visa as we all had green cards then? What is the relevance of that?

    The quickest way forward is for your Mother to open a Personal Tax Acc. She will need a UTR number. This should be on a copy of her last tax return. I assume she has a copy. Looking at it will also help you to complete the 2018/19 tax return.

    Can you not have your Mother sit with you while you open a Personal Tax account on her behalf?


    That is probably what we will have to do, once I've located all the documentation.

    It is in force it is just not being used, you do not need to to lose mental capacity before an attorney can act for you you just need to give your permission.

    Or he have just filled it in for her on line. Agents are usually professionals, and I believe HMRC also have something called a trusted friend who can be given permission to help with your on line tax.

    I would give HMRC a call and ask what you need to do to complete her tax returns as her attorney.
