  • I can't see the retailer sending the item back for repair without the OP paying again. Down the wetsuit and the money.

    The good news is a quick google shows plenty of wetsuits within budget and some are even reduced in sales!

    For a consumer rights forum I'm quite surprised how many people think I not only deserved to have no warranty service at all but even to have money deducted from the enforced/ unsolicited refund even though I've done nothing wrong according to the terms and conditions.


    To be fair to everyone else, as a consumer rights forum is it perfectly right to point out that "You returned a faulty item and got a full refund of the purchase price" is an absolutely correct way for the retailer to apply your consumer rights.


    The warranty does not form a part of your consumer rights.
    (Although I could be wrong, I often am.)

    Well if your not happy with the replies you could try citizens advice bureau or CAB or even a lawyer.

    I think everyone is being a bit mean here. It seems to me if the price had dropped further, rather than going back up, I'm sure the OP would have been straight down the shop to offer to make up the difference. :rotfl::rotfl::rotfl:
  • It seems quite clear to me; if you bought it from anyone else other than XCEL.EU then you must deal with the retailer and not directly with Xcel.

    It is quite clear but it does not say what you believe it to say.

    2 scenarios
    warranty repair return direct to manufacturer
    return as unwanted
    return to manufacturer if bought from them else return to retailer

    The retailer has every right to interpret that you wanted to have a refund as you did not sent it back to the manufacturer for a warranty repair but mistakenly returned it to the retailer as this is what you are instructed to do if you don't want a warranty repair( regardless of what the law says)

    Sorry, what?... as throughout this post, you’re not making much sense.

    Because the information you were given was not what you wanted to hear does not in anyway make it incorrect! I will refer you back to my previous post, let you fb friends tell you how right and hard done by you are:rotfl:
