Smart Parking

  • I have just recieved a 'letter before claim' from CST Law. Is this the point where I need to do something or is this still part of the fiddle? To save reading the above - I paid for parking but I entered the car park 11 minutes before I paid because I was downloading the parking app and left the car park 4 minutes after the time was up.
    Thanks

Plus read the second post of the newbies FAQ sticky thread near the top of the forum again , especially LBC stage

No, except read the CST Law group thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

  • So
    1. Email a SAR to Smart Parking
    2. Email CST Law
in accordance with the examples/instructions in that second thread?

Do I still complain to the retail outlet where I parked or are we too far along the process?

Always , always complain to the retail outlet or landowner , it's never too late
  • Ok, I've complained to the Tenpin Bowling place about the whole debacle.
I've emailed a SAR to Smart Parking
I'm about to email a letter to CST Law. I notice that the examples given on here mention the additional charge over and above the penalty afforded by SP. I can't remember what it was and didn't have the original letter from SP but google earth shows a sign in that car park with a big £90 printed in white on an orange background so therefore i'm using the diff between £160 and £90. That would be correct wouldn't it
"You state your client claims an unlawful additional £15 for ‘time spent and resources facilitating the recovery of the charge’, included in the total charge amount. If as you say this is included, this leaves an additional unlawful charge of £70 on top of the maximum penalty of £90.00 afforded by Smart Parking. You have stated that the £15 is for recovery so please explain your legal authority to increase the parking charge by an additional £70?"

You have a good idea about that topic , even though CST or other companies will chuck it back in your face , it's a paper exercise , nothing more
