Thanks Coupon-Mad - the judge found that the Claimant had not given proof they have the right to ticket on the land as the agreement expired pre ticket and they had not put in proof that the contract had been renewed so this is something to look for in future. The judge took issue with my tardiness and also that the Skeleton Argument was not signed but I explained the circumstances around this and in the end he accepted my defence and relied upon that. Thank you everyone for your help - these robo claimants are a scourge of society.

In view of this quite clear judgment from the Judge, why not give the PPC a dose of their own medicine by making life uncomfortable for them?
Write to the DVLA and complain that the Judge determined there was no current landowner authority to issue or pursue parking charges or that the PPC has authority to operate at this site. Ask that the DVLA investigates and reports back to you. In particular they should calculate how many charges have been issued, and should there be no valid landowner authority, the PPC should be required to cancel all charges for that site and repay motorists who have been misled and paid. If you get a fob off from that approach, follow it up with a full blown Freedom of Information request. It will be more difficult for them to hide under FOI.

There has to be some process of backlash against PPCs to make them think twice before issuing of tickets and court cases on a scattergun basis and their unchecked harvesting of personal data from the DVLA on an industrial scale.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You shoudlalso point out that the DVLA, as the data controller, failed in their duty to share data with reasonable cause. This leaves them liable.3

Great news
This is once again a demonstration of why BWLegal lose. It is the fault of BWLegal that they lost for Premier Park. Had BWLegal done their homework and asked Premier about the contract it might well have resulted in Premier being advised that they had no case ? What a waste of time and money for Premier.
This is the problem of a robo claimer and I am certain the courts have their eye on BWLegal and their claims, especially the fake add on and their stupid claim that they can add on fake amounts just because the code of practice says so .... it's such rubbish that courts must be getting fed up with it
Looking forward to what the courts do in future ...... it will end in tears but not for the motorist

Hi all,in terms of chasing the DVLA - if Premier Park has a contract for the site then surely the DVLA is in line giving them details? I flagged to Premier Park / B W Legal in my defence that I had authority to park there with a letter from the landowner but they still went to court and despite optically preparing well the fact that they are robo claimants is shown up by the lack of specific interest in each case. The telephone court is suiting them as they do not have to travel so it is great that they were represented and still lost.Thanks all.1

Sadly they have developed a culture that is considered 'too close' to the parking firms, for over a decade, and some staff there know no different.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You need to be assertive, persistent, and robust. It took me several months to get a refund of £14 from them, it must have cost them £££s.You never know how far you can go until you go too far.0
