  • We have received a reply from the company saying that there are signs; which we know and stated that we had to go back to find it as it wasn't near where we had parked. It also says that we went over the time that we paid (as they are now acknowledging that we paid). Which yes we would have if you count from entering the car park to leaving. This isn't stated on their signs that we could see. We went over because of finding the signs, finding the right change and as said before having to keep going back to the car to ensure we had the correct reg plate.

    ANPR cameras monitor time on site , not parking time

    so if you read the BPA CoP you will see they allow grace periods but not for a 47 minute overstay

    PP will state that 2 hours should have been paid for (unless they have a charge for 90 minutes ?) and that grace periods do not cover the overstay , so by not paying the full amount for say 2 hours the driver is liable for the £100 default charge on the sign

    if the driver has been outed by you , then there is no POFA protection

    if the driver has not been outed , then its likely that PP failed at least one of the appeal points , namely nt including the details required by POFA, possibly failing POFA warnings and also possibly failing POFA timescales too

    if they rejected your appeal, they should have issued a popla code /

    in which case, get on with your popla appeal as a hirer or lessee of the vehicle , especially on the following poings

    failed POFA - no hire or lease docs included with the NTH
    failed POFA - wording ?
    failed POFA - hire vehicle timescales ?
    no landowner authority
    poor and inadequate signage
    no contract

    etc

    Private parking car parks are bear traps and all motorists need to become very aware (and wary) of the signage showing the limitations imposed by the PPC, with the prime intention of financially enriching themselves (at the cost to the motorist) from even the most minor of  transgressions. 

    47 minutes overstay ......... very, very thin ice. You've got to look for legal/technical loopholes, especially around signage and landowner authority. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
