broken elbow injury claim - valuation - is it fair?

my concern is my representative states that since 2015 such claim payments are reduced and thus any prior payouts to that time period are no longer relative...not sure how accurate that is, hence this thread.0 -

Thanks - I work in care and have cared for some people with serious head injuries. I remember sitting in the middle of the road checking my neck and recognising my head seemed okay and feeling relieved even then. I was in the ambulance and the police officer stuck his head in and said "What's the score?" The paramedic said "I think he's broken his shoulder, but nothing life changing." Again there was a huge surge of relief to get that confirmed.
The medical care through the insurance company was very impressive and must have added substantially to the cost, though I never saw a figure for that. The guy who assessed my knee, which was troublesome for a while, said I had a fear of cycling in places I perceived as unsafe and they agreed to 10 sessions of CBT, which was very helpful.
I'm convinced all that aftercare wouldn't have happened if the solicitor wasn't a cycling specialist. My solicitor played hardball, the guy refused to accept responsibility so she booked a court date and his insurance company caved and paid everything she had asked for, about two weeks before the court date.
I can't help with the change from 2015, but it might be an idea to post in some of the cycling forums, such as cyclechat or bike radar and ask for any recent experience.0 -
