Brilliant, and very happy to hear that the forum advice works even for those (possibly many more than the new posters here) who just read the forum, use it as a resource and never need to post - till they win!

Thanks very much. No pressure but I, for one, would love to see redacted copies of your defence and WS. Again, no need, this is well behind you now so well done! But if you fancied posting those I would love a read and I am sure a few others would too.

Yes please to posting a copy of your defence and witness statement! Thank you for posting well done it's most helpful!
  • 2. POPLA are a toothless formality. Submit your appeal to them as a matter of process, but their outcome stood for nothing in court so don't sweat it.
If you have a decent case that would fall within the remit of what POPLA look at, then it's worth some effort in trying to kill it off at that stage.
    5. The judge wasn't interested in 90% of my defence and made that clear - My advice would be keep your witness statement as short and sweet as possible.
But which 10% was your judge interested in? And would another judge be interested in a different 10%? While I understand the sentiment, you don't want to be omitting anything important in the WS, as what you omit may be the killer point that wins the case.

For sure, go through the motions but doesn't matter either way if it gets to court.

Signage & contract - Easiest route to decision for Judge.
  • Congrats!

I definitely agree with a lot of things you say, it is very possible to beat these people with the advice from this forum and again I thank you all.

I did everything via email and didn't have a single problem so that is a very good point.

BW legal are terrible but the rep they sent did actually seem to know what she was talking about and I did have to fight my corner, the judge definitely didn't give me an easy time but he gave her a harder one! I was very bad at referring to the judge as 'sir' but I don't think they are very strict on that and as long as you're polite will get on fine.

Although saying that BW are 10000% more effective and on it than Gladstones, whom I have found to be totally incompetent and take several months to reply to every email.

Court day isn't as daunting as you would expect but is still not something I fancy repeating any time soon, and I would consider myself pretty confident.

I definitely agree that the judge was not interested in 90% of my defense and don't think he looked at it at all throughout the hearing, he pretty much just started from the bare facts and got us both to say our sides.

The rep specifically slated on-line forums in our very brief pre-hearing 'chat' before I then went on to beat her based on advice from this on-line forum, so I hope that made her reconsider her statements! I like to think that we ruin BW legals day on a weekly basis.

I would imagine that the Judge's are so fed up with these BWLegal claims that they look for the fastest way to dismiss the case

Of course the rep slated online forums, they expose BWLegal and BWLegal cannot beat the truth
The rep in the words of BWLegal was nonsensical
