CCJ from Civil Enforcement LTD

Received a letter from Civil Enforcement LTD in regards to a CCJ being issued against me in November 2019 by Northampton County Court. I have no recollection of any previous letters, just the one with the CCJ being issued against me.

I had an aggravated assault burglary occur at my home address early November 2019 which led to my home being unoccupied until early January 2020 due to safety concerns.

I paid the judgement which was roughly £280 yesterday. Having checked my credit report - I noticed a CCJ being issued resulting in my credit score to sky rocket downwards.

I have no issue with the fine or the amount. I am not the driver, just the registered keeper of the vehicle.

I would like any assistance if it is still possible to get this set aside with or without consent. The judgement has been paid (yesterday) albeit not within 30 days.

    What fine? Do you mean "judgement"? Did they include an unlawful £60? If so read this.

    Why not? Nine out of ten of these tickets are a scam.

    [FONT=Times New Roman, serif][FONT=Times New Roman, serif]Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Payment makes very little difference to your chances of a set aside.

    As always the starting point is :-

    Why did you not know about the court claim ?

    You didn't live there due to circumstances which could be described as meeting most if not all of the discretionary requirements of the rules.
    1. there is a reasonable prospect of successfully defending the claim; or

    2. there is some other good reason why:

    (i) the judgment should be set aside or varied; or
    (ii) the defendant should be allowed to defend the claim.


    However, call the court and see if they actually served the court papers on that address. If they didn't it changes things massively in your favour. CPR 13.2 is mandatory and the requirements less stringent upon yourself.
