What happens to a disabled bay once the disabled person has moved on?

I live in a small cul-de-sac with 12 or so houses and there is 5 parking spaces right outside. If these are not available, you have to park on the road you enter from. For one of the neighbours, his wife is disabled so we always leave that space free. They have however applied for a disabled Bay. This will be 2m wide so will remove one of the parking spots next to it.

Once they have moved on, are the council in any way obligated to revert it back to an ordinary parking space?

  • Unless there was a TRO in place anyone could have used it. The markings were no more than a polite request not to park there. I doubt the council will do anything.

    The letter we received says a PCN could be issued if anyone parking there doesn't have a blue badge.

    I think some councils (including yours, it looks like) do enforce the rules, for others they are not enforced and the scheme relies on the cooperation of neighbours and their visitors.

    As I understand it there is no obligation for a council to return a bay back to "normal" if the original applicant moves away. They may do if asked, but they're not obliged to and my understanding is that they don't, simply because although the bay was requested by an individual, it is a civic amenity available to all eligible people and if the need arise for it once, it is likely to be needed again at some point.

    Ask them to send you a copy of the TRO, if they haven't got one they cant enforce it.

    Assuming it's a legit disabled bay, then it'll remain as a legit disabled bay. Anybody with a blue badge can park there - as now.
  • We had a disabled bay outside our house for a lady in a house down the terrace. She moved on and I asked the council about it. They sent a letter to me saying that it was no longer needed and anyone could park there. It did eventually get removed when they resurfaced the street. I guess it depends on your local council ?

    In our area Disabled parking bays are 5m long, so I assume the 2m you mention is 'end on' to the pavement. Thought it would be rather short.

    When the person who has been entitled to the disabled parking 'moves on' the council remove the disabled parking sign and anyone can park there. Eventually the get their contractor to come along and black out the markings returning it to a standard parking bay.

    Although objections can be lodged against the removal of a disabled parking bay by anyone, not necessarily by people who live in the area, although there is typically then an investigation as to its ongoing use. This Oxford Mail article published today about creation and removal of local disabled parking bays contains one such example.
  • Get some black masonry paint and cover it up; job's a goodun.

    It stays they for good? Unless you complain however it’s good to have one near by.. also you can uses it. They no fines on them ones. I’d uses it as your own parking bar
