Dear Experts
I hope you are able to help - and sorry if this has already been discussed, I can't seem to find any thread that goes through this kind of problem.
I have received a letter of claim for a parking charge notice, dating back to April 2016!!
This latest letter is from DBC Legal.
But Its been round the houses regarding debt collection companies - DRP, Zenith Collectors, VCS, BWLegal.
Basics of the story is that my car received a ticket whilst being left with a garage for the repairs.
I have a letter that the garage have stamped confirming the name of the driver.
Which I have sent to BW Legal back in Jan 2018.
I really want them to close the case and stop harassing me as I have not done anything wrong. Would really appreciate it, if someone could post a link to a sample letter that says something along the lines of:
Close the case and stop harassing me as I wasn't the driver and here's the proof or I will start harassment proceedings against you Or Go ahead and start the court proceedings and take me to court - but stop telling me that you might just do it!
Any advice really welcome.

You sent the letter to the wrong company. You need to send it to the parking company whoever that is.0

It BWLegal who requested that I provide the info.
"We request that you provide the driver details of the person driving your vehicle at the time of the contravention"
So I responded directly to them.0 -
OK, so now repeat to DCBLegal and the parking firm (copy to both, including the request fro BW Legal to, so they can see the communication chain) that you provided the name and address of the driver several years ago.
As such, say that, if they now proceed to a court claim due to their own incompetent record-keeping and abject failure to understand the applicable laws and erase your data as keeper, this will breach the Protection of Freedoms Act 2012. And you will counter claim for not less than £500 if they try.
Give them 14 days to confirm the case is cancelled or tell them you will report VCS to the ICO and you are aware they have been investigated a number of times in 2019. Do they really want to start January with yet another ICO complaint for a consumer, this time about them processing keeper data for YEARS, that was only provided by the DVLA for the purpose of enquiring who was driving, and VCS should have erased as soon as they had the driver's name and address...etc.
Do the above by email to both.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
