Parking Charge Notice from Minster Baywatch

Hi all

Last month, my sister in law borrowed my car to go to Meadowhall, she is pregnant and has a limp when walking so that day she parked in the disabled bay for 10 minutes, thinking that she only needed to pop in the shop real quick and left immediately, plus the difficulty of walking made her do the wrong thing. After 10 minutes, she came out and received a Parking Charge Notice from Minster Baywatch. She tried to explain to the guy giving her the ticket about her pregnancy (a very big bump) and her limp but the guy shrugged and said "not my business that you are pregnant, you don't have a badge".

She is in financial difficulty so she cannot afford to pay the ticket. Needless to say she has realised her mistake and won't ever do it again but would like to know if there is a way for their human sympathy to kick in and let her off.
As far as I know, these PCN are not from councils and therefore not enforceable because it's just an invoice. So should we ignore it?

    OP, have you based your forum username on your real name?

    If so, you would be well advised to get your forum username changed to something completely anonymous.

    To do that, you might like to read this short extract from The MSE Forum Guide - Frequently Asked Questions & Rules:
    Q. How can I change my username?

    A.
    In most circumstances, this is not permitted.

    The only reason we will change your username is if it puts your privacy at risk. This usually means you've inadvertently registered using your name, email address or something that gives away your identity within your username.

    If you fall into this category, email forumteam@moneysavingexpert.com and request that it is changed, giving three alternative usernames in order of preference.

    You are wrong , they are enforceable , in a court of law , Google Barry Beavis

    Plus the ticket is in your name as registered keeper

    Those disabled bays are provided by law under the Equality Act 2010 for anyone who qualifies and nobody else

    Is she paying it or are you going to go through the hassle of appealing , then popla , then your local county court ?

    Human sympathy won't prevail

    Ps , does she qualify under the EA2010 due to her limp or her pregnancy ?

    Qualification under EA2010 is what none of us knows, she is always broke she has never owned a car herself.

    If it's enforceable and human sympathy is not something Minster Baywatch will even care about, I will just pay it because of her financial difficulty.

    if MB complied with POFA then you as RK are liable for what the vehicle does, even if you were not the driver , its one of the perils of lending out your vehicle

    check the NTK to see if it is POFA compliant first

    bear in mind that she should be made aware that its never ok to park in a disabled bay without the backing of the EA2010, not for 5 minutes , never mind longer

    check the BPA CoP to see what it says about how much grace period (if any) is allowed in a disabled bay
