    I doubt they'll pay any benefit while she's in hospital, the state are already paying for her food and bed.

    If she has worked and paid stamp any benefit would be contribution based which she would get even if she was a millionaire. It will also be paid while she is hospitalised.

    Income based benefits are a different story.

    Her company will pay at least statutory sick pay of £94.25 a week for up to 28 weeks, this begins after the first 4 days off.


    Some solicitors on taking the case if they believe it is a winner will also pay you an upfront advance.

    Yes they will. I got benefit, though I paid it back through a higher tax code, and then again from loss of earnings restitution by the insurance company.

    That all depends on whether you believe that the increase in the standardised compensation amounts that a lawyer could bring will outweigh the percentage they will take.

    Absolutely do NOT deal with the drivers insurer. It is also likely they may try to contact her directly. DO NOT deal with them.

    My wife had a serious accident about 15 years ago which took 3 years to settle. Her car was written off and was settled very quickly but her injuries and loss of earnings took 3 years and a court hearing to settle as the 3rd party insurers were quite nasty but in the end my wife won her case.

    As it's early days she needs to start keeping documentary evidence of her incapacity, out of pocket costs including anything related to her incapacity and recovery(eg phone calls to solicitors, taxi fares (get receipts) if used and also keep a diary of her incapacity and what she is restricted from doing that she normally does - gardening, any household chores etc). If she sees a solicitor I'm sure they will advise her of this.

    If she has any other insurances or is a member of a union she may be able to get legal representation that way.
