Advice required please

Hi, everyone as the titles say I am after some advice please. I put a ppi claim in to Barclaycard, they have sent me a cheque which I think must be under plevin. They are saying that I signed the paperwork in branch and are confident I would of been advised and given the correct information at the time. I put in my claim that during having ppi I tried to cancel the policy several times but I was always refused as I had a balance on my card, I mentioned also that I went self employed during this time and again rang them and asked to cancel as I wouldn't be covered with being self employed. They say they have no records of me at anytime trying to cancel the policy and no record of me notifying them that I went self employed. They also said they couldn't find the records of all the payments I had made or of all interest the rates over the years, yet they are convinced I was given the correct info at the time of taking out ppi. Do I have a case to take this to the ombudsman or being as they have sent a cheque can I not take it further, and if I bank the cheque and then am able to take it further what would happen if I won or lost ,i have seen somewhere about you cant claim twice, I feel I am not but I am a little confused. Sorry if this is a bit of a waffle any advice or help would be much appreciated, thanks Dave.

    The cheque relates to a ‘Plevin’ refund, as such you will be fine to bank this and will not stop you from taking further action should you wish.

    As to should you take further action... ultimately it is for you to decide, however from what you have said they have assessed the sale and found no issues with the process or your eligibility for the policy at that time - this is unlikely to change. With regards to your attempts to cancel, without any supporting documentation from either party then this is going to go nowhere, for future reference I would recommend any such requests be made via email so you have an audit trail/evidence.

    If there is no evidence or anything that points to wrongdoing then the assumption is that their process was followed.

    The very limited information you have given does not suggest you have a strong case. A bunch of unprovable allegations are weak as far as complaints go. It is impossible for us to judge a FOS outcome as we dont have access to the full information. Just what you tell us. Hopefully, your complaint has more to it than what you have told us.
