DCBL Parking - service station

Hi

I wonder if you can help. It appears I had a parking fine in 5th dec 2014 for overstaying at a service station. I say that as I don’t recall getting a ticket or notice at the time. The first I heard about this was a letter dated 13 December 2019, 5 years later from DCBL which is a ‘notice of debt recovery’ stating that a further 70.00 plus
VAT admin and recovery has accrued and 184.00 is now
Due.
I have now received a follow up letter for pre enforcement that they will be advising their client of taking legal recovery action which includes a warrant / writ to remove goods, attachment of earnings, cha
Charge on property and preventing future lending.

The thing for me is this is 5 years ago surely this would have been flagged with me sooner, I can see it’s my old car that I sold 3 years ago.

What are my options here should I just pay the 184? Even though I never received a notice nor heard from anyone in 5 years since the offence? This has totally blindsided me and not expecting this at all.

    In my opinion, if they took this to court they would struggle so I suggest that you invite them to do so. You might also like to complain to the MSA management.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Its not a fine and nor is it an offence

    As there is no wy they can hold YOU liable *as the keeper of the car*, I suggest you invite them to take you to court, as they have not followed the requierments of POFA2012 schedule 4 para 9. As this is an unremarkable event from 5 years ago, and this is the first you lknew of it, you cannot be sure who drove out of the possible X people who regularly used your vehicle and of course, any of your friends who have "drive other vehicle" cover. State that of course, as they know you have an absolutel defence to their claim ,one they have no evidence to counter, taking you to court will be a waste of your time and of course the courts, and so you invite them to accept your one time "drop hands" offer and cancle this PCN within 14 days. Should they refuse, note you will claim from them for breach of data protection - after 5 years they must not be processing your data, as they have missed their one and only chance to hold you liable as keeper - for a sum of no less than £500, and you will apply for your full costs on the indemnity basis at £19 per hour.

    Can everyone with a DCBL pre-enforcement letter just read all the other threads about a DCBL pre-enforcement letter...please?!

    MOTO ones and CP Plus ones have been answered this week already.

    There is no need for new threads about it, as the answers are here with one search.
