Virgin Phone contract - Refund?

Hello :)
Apologies if I've started this in the wrong section of this website, but I hope someone out there may be able to help.

My father in law has had a Virgin Mobile bill taken out of his account for years, always assuming that it was for his wife's phone. Not quite sure how they realised, but between them, they realised that it was for a contract that belong to neither of them.

They cancelled the direct debit, Virgin wrote to them, saying to resume service pay etc. He obviously called them, and long story short, he's been paying this SIM for six years. Between 2012-2014 a two year contract was taken out (he realised it will have been for my other half or his brother when they lived at home) but ended in 2014 and without realising he's been paying it ever since!!!

Now my question is; whilst my father in law should have checked his account, do Virgin have some responsibility in contact him? They can see after 2014, not one scrap of data or call was made? We'd like to try and get some money back as its around £2,000 but we'd like to know where we stand first.

    You may get a goodwill gesture, but they have no obligation to refund him.

    I can't see you getting £2K back because Virgin have absolutely no liability.

    Why would they be obliged to make contact simply to say the phone wasn't being used?

    Wouldn't that be regarded in some quarters as somewhat intrusive?

    As above, you may get a goodwill gesture of (some) money, but approach carefully as you have no legal right to any money at all..

    So the brother stopped using the sim then, it was up to him to say he wasn't using it and for your fil to cancel it then.


    No harm in asking but be prepared for either No way or get offered a portion of the amount.

    I was in a similar position a few years ago - I ordered an o2 pay monthly sim and never actually activated it as I went with another network. I didn’t realise I’d been paying £30/month for 11 months (I know) and called o2. Not only did they offer a full refund (without me asking) but they also offered £25 on top for D&I for having to call etc. (I think the girl was new as she was so intent on resolving the issue I don’t think she was paying much attention to me, which worked in my benefit as the most I was hoping was to have the remainder of the contract cancelled so I wasn’t paying more unnecessarily).

    It’s not impossible but they certainly don’t have a legal obligation to refund anything.

    Explain the situation to them, ask very nicely, and they may refund you.
    There is a vodafone rep on these boards, they may see your post.

    Contact them and be nice and polite about any request, as you are ultimately relying on their goodwill for any refund... go in too strong and you may find that goodwill used very quickly

    The OP's contract is with Virgin, so I can categorically say Vodaphone won't be refunding. :)
