Gemini PCN - appeal rejected

  • Hi all, I’ve had no response back from the estates manager. I would be due to pay the £60 by Monday 27th Jan.

Would you suggest I appeal via popla? Where do I stand in terms of an appeal bearing in mind I basically admitted being the driver in my original email to Gemini? With my popla appeal do I take the approach that I am just the keeper of the car and not the driver?
My thinking is that as I am already paying to park at work, why should I be charged to park on this land, it just seems ridiculous.
Do I have a leg to stand on with an appeal or do I just suck it up and pay the 60?

    Thanks all for your help

In the 8 days since, what other threads have you read, so you can form your own opinion on the viability of appealing?
Bearing in mind the PPC submits their response to your POPLA appeal, trying to pretend now you were not the driver is a bad idea. Easy lie to be caught out in.

Much as the estates manager might enjoy twiddling their thumbs, it's you who have the deadlines to contend with. Give them a firm nudge, re-stating the facts and the obvious unfairness of this parking charge.

Did you select the 'driver' option when appealing to Gemini? Or keeper? I'm referring to any drop-down menu. If driver was just implied, it might well be worth appealing to POPLA as keeper. In any case, it sounds like signage would be a key feature of the POPLA appeal.

Put aside indignation (tricky!) long enough to appraise the area in which the car was parked with a very cool head. The signage is very likely to be inadequate and you've said as much already. Take photos which will help you word your signage section as well as some which will clearly illustrate your points.

Hospitals are real so & sos when it comes to staff and patient parking. I'm getting desperate for someone to have a breakthrough! I'd suggest POPLA - if you do need to appeal as driver, it is still worth doing. But dig your heels in with Estates Management at the same time as preparing your appeal.

What a lousy way to treat hard-working NHS staff, don't give up just yet.
  • I read your thread and wondered...
Did you mean when you appealed you mentioned that you had dropped your daughter off first which meant you arrived later at your place of work than you usually would have? Therefore the staff parking areas were full? Meaning you didn't have a choice but to park outside of the designated staff area?
It might not have been clear to others....
This is what is happening at my place of work, once the staff car parks are full, usually around 8.30 am we have to find alternative places and that's when the PCNs are being issued....
