Care Costs - Joint Account

Looking for some advice on assets and care costs for my parents.
Mother is now a recent resident in a care home with dementia. Lacks capacity, no one has power of attorney, we are currently applying for court of protection order.
As part of this we have to list the assets ,money my mum has, She has a number of accounts in her own name , totalling over £23000.
There are then a number of joint accounts , one for example has my fathers work place pension going into it, which far exceeds the state pension that is paid into which is my mothers.
So the joint account assets are not 50/50, but will be assumed to be split as such? Can we argue that they should be not split like that and if so how and to who?

A joint account will be treated as 50/50, hopefully they have not let the balance get to large. Going forward he would be better off moving he income into a separate account.
Has he sorted his LPA out, you don’t want to risk going through this twice.0
