Accident denial

Options
Hi,

I am hoping someone can offer some advice.

5 weeks ago a van hit my read side panel whilst driving. They turned off onto a side street, I turned round to go down the street and couldn't find them. Luckily I had dashcam footage so contacted the company who spoke to the driver and acknowledge the accident.

It was all reported via insurance as normal. I have now heard back from them 5 weeks later saying the company are saying they have no knowledge of an accident. Luckily I saved the dashcam footage to my computer. As the van hit my rear drivers door it was not directly caught on the dashcam but I pass the car and then 2 seconds later my car is hit and the rear moves out and the front of the car pulls to the right.

I feel like I have been scammed now as they are trying to pretend nothing happened hoping I don't have any evidence. I feel annoyed I didn't inform the police of them driving off, but as I spoke with the company and they admitted fault I wanted to give the driver the benefit of the doubt in that he had pulled into the side road and I couldn't find him, several roads go off the side road.

Does anyone have any knowledge of if the dashcam footage is sufficient? As I say it doesn't show the van hitting me as it hit the back of my car, but as it happens seconds after I pass him and I don't pass another car, there isn't really any other explanation for it...

Many thanks

Except there probably are several explanations. Some maybe fairly believable and some may need need a blind person to view the footage.

Assume you passed it onto your insurer so wait and see what they say.

Civil law works on the balance of probability.

So if your evidence makes your version of events more believable, that's what a court would accept as what "probably" happened.

Hopefully it won't get to that stage and they will admit liability but any supporting evidence you can provide will help convince them (or at least their insurer) that it would be unwise to take it to court and increase their costs.

So they were coming towards you, they go out of shot, your car is immediately hit (the movement and sound of which you have footage of), you turn your vehicle around and there are no other vehicles there, the van having sped away?

    Sounds fairly damning to me.

Just pass it to their insurer, and let them deal with it.
