VCS county court stage - witness statement review please

    So I’ve had some documents from vcs today including the claimants witness statement and evidence for a forth coming hearing I’ve heard nothing about. The witness statement says this is listed for 24th July.
    i don’t really know what to make of it.
    it says the claimant wishes to relay on precedent set under Vine v Waltham Forest LBC (2002) I WLR 2383,2390
    also quotes parking eye v beavis (2015) UKSC 67 and (2016) AC1172 and in absence of driver details they rely on sch 4 of protection of freedoms act 2012

    You don't know about the hearing? Have you not had the court letter?

    have you filed YOUR WS with the court and claimant? You knew to get this ready.

    I haven’t filed anything with the court since my defence statement as like I say I have not been notified anything by the court. To be honest I didn’t think they’d be sitting again yet.

    They haven't stopped sitting, they're just 'sitting' in different ways - paper-based hearings, by telephone, by video link.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Have you had a DQ - N180 form?  Worth logging in to your MCOL account (the one where you did AoS) to see what the situation is, they usually update when your defence is received and when they issue/receive DQs.  If it states that a DQ was issued to you, make sure the CCBC has your correct address for service and also then download one, complete it and submit it by e-mail,  Details for doing this are in the NEWBIE sticky in Bargepole's link called know what happens when.

    You cant have sat back like this. 
    Do you know which court its listed at?
    Did you not file your DQ? You knew to expect one, as per hte newbies thread
    You should have had at least 3 letters sinc efiling the defenc e- DQ, letter allocating to your local court you named in the DQ, and then a court hearing.

    Yes I did file my DQ as stated in the thread. I haven't sat back I was waiting to hear. I don’t know why I haven’t had anything from the court  .... but I don’t believe that’s my fault??

    I’ve checked MCOL. They have my AOS and DQ and it says it was claimant filedDQ and it was transferred to the court I requested. But nothing else - should it say something else if it’s been transferred to court ? It’s so odd that I’ve heard nothing since filing the DQ.

    Once a case is transferred to a hearing court the CCBC, and MCOL, play no further part.
