Proof of deregistering as self employed?

Hi

So basically have recently gone from self employed to employed. I have been claiming universal credit and have been told I need to book an appointment with the job centre to show I am no longer self employed. My only question is that will I get a letter from HMRC to say I am no longer self employed?

  • You need to call HMRC to tell them you are employed and then they will send you a letter confirming it’s been actioned
  • I doubt HMRC would do anything with such a letter.

HMRC will reply on your new employer notifying them you have started work by sending HMRC a real time information report. This isn't proof you aren't self employed as plenty of people have a (PAYE) job and run their own business.

Why do you think DWP won't just accept what you have to say?

It is going to be upto a year before you file your next Self Assessment return, which will show the date your business ceased.

The reason DWP ask for "proof" is to distinguish genuine people like yourself from those who may be impacted by the MIF and/or may no longer wish to be treated as self employed during a period where they may just have no/less work.

In your case, the fact that you are now employed may be sufficient evidence, so a letter/contact of employment from your current employer or a payslip etc would be good evidence.

You can contact HMRC and ask them to de-register you as self employed, which they will do. Ask them to send you notification (email or letter) to confirm this has been done, although you may well not receive this by the time of your appointment with DWP, but you can at least advise them you have taken this step.

Other acceptable evidence might be selling assets essential to your self employment (tools, vehicle etc), closure of shop/premises and online websites for your business, or final accounts upon cessation of trading. DWP will want to establish that you are not continuing to trade self employed after you have declared that the business is now closed.

That will depend on the person and the circumstances. The ALP does ask for evidence to confirm that the self employed has ended when making a decision to end self employment. If the decision maker suspects foul play they are within their rights to request evidence and suspend/close the claim if the claimant is not able to provide it.

The self-employed trained work coaches are the DM's for self-employment.

Evidence can be verbal, however your new employment contract would also suffice to show that you have ceased self-employment.
