I wonder if this will be looked on as rules or just guidelines. Shades of pirates of the Caribbean.

    Read the new BPA CoP

    It doesn't mention not being "fined"

    It mentions minor and major errors , where anyone receiving a PCN "fine" can appeal it and either the PCN is cancelled or a reduced fee is charged

    I doubt that this change will stop PCN,s being issued

    What is the point, with the new code of practice due (overdue), who is going to take any notice of the BPA.

    Why on earth don't these articles start investigating the IPC scam ?
  • PPCs purse with a vengeance anyone who dares enter a slightly incorrect registration in one of their machines, or confuses I/1 or O/0 (which are identical on number plates), yet they are quite happy also to purse a claim where the NTD has the incorrect registration filled in. Hypocrisy? Who'd have thought.

    Examples of a minor keying error could include:

    0 instead of o.
    I instead of L.
    1 instead of I
    Up to one letter wrong, removed, or swapped
    Up to one number wrong, removed, or swapped
    Numbers and/or letters in the wrong order (but where the correct registration is still recognisable)
    These are minor errors where up to one character has been entered incorrectly, or where the registration has been entered in the wrong order. If a typing error such as this leads to a PCN being issued and the motorist appeals, the PCN must be cancelled at the first stage of appeal.


    Maybe I'm too much of an optimist but this has to be useful in a lot of cases, even if they chuck the appeal out would it not carry weight at any court case?
    Pity it did not say that the operator should not give a ticket at all in these cases and save the victim unnecessary stress.

    We all know what will happen in reality, PPCs will ignore these new rules - to a point.
    they will still send out the usual threats and only when its taken to POPLA will they cancel, and thats if POPLA chose to use that point

    Most people will pay the "fine as it will go up if they don't", so buisness as usual.
    And on top of that you have Will Hurleys cosy club

    There are a couple of threads about the new CoP already.

    The BPA said minor keying errors should not result in a PCN over two years ago, and this was re-iterated in the 2018 PoPLA annual report.
    This begs the question, why has it taken over two years to get the CoP changed?

    I doubt it will stop PCNs being issued because the majority of motorists won't know about the CoP, let alone the changes, and many, far too many, people will cough up without first doing any research.

    Whilst the keying errors change might help some motorists, the tightening of grace periods will have a negative effect. Methinks the latter was causing too many PoPLA appeals being successful for the liking of the scammers.

    Not only will it carry weight but will also provide evidence of the "unreasonableness" of the claimant in issuing a claim.

    (So looking forward to more discontinuations then)

    The panic and pay the fine brigade will still pay up, and the ignore everything lot will stop end up with a default judgement.
    The only way to stoke out misskeys is to have the system reject reg numbers that don't exist on the system, but that would mean fewer charge notices and in turn less money flooding in

    First part of any court defence is, and always has been, de minimis for these.

    It also irks me that people always assume they keyed it incorrectly when it's not always human error !
