    Hi guys,
    In June I had a letter asking for my case to be heard on paper - I requested not to and haven’t heard anything since. Is this normal? How long do they have to take it to court?

    Was the letter from the court regarding this ?

    It was from the court via email. I returned a form N159 saying I didn’t want it heard on paper. Any idea what the next step is?

    You contact the court and ask them.   The courts have been pretty screwed up of late due to Covid but, you still have your rights

    Maybe it's sitting in a box waiting for a hearing by phone to be allocated but you can ring and ask, and also send in a fresh N180 DQ if you want to add any winter months into your 'not available' list of dates.

    Or it never arrived, and...
    check with the court. They have the definitive answer. Anything else is just a guess.

    Thanks - I will check with the court this week. Here was me hoping they’d let it go!! 
  • I have been allocated a telephone hearing in October. They said I would be informed what I need to do next. I saw a link somewhere with advice for telephone hearings, so will have good read of that.. (if I can find it again). I assume it’s much easier for so called representatives to attend a phone hearing as opposed to attending court. I’m a bit nervous now.

    Or to put it another way, it is so much easier for the Claimant or their solicitors to attend a phone hearing that they really have no excuse for not attending or for hiring an advocate.

    As they fear cross-examination, there is a very real chance that they may discontinue.
