Wowcher purchase faulty

Hi
Just wondering if I can get any help as I’m at a loss. I purchased an iMac for my daughters Christmas present. She’s 16 and doing her GCSEs so really wanted a MacBook. I found one on wowcher and ordered it, wrapped it and put it up for Christmas. Upon opening it on Christmas we found that the operating system is that old no programs can be downloaded and also the battery is faulty and will not hold a charge at all. I’ve emailed the company and they want me to weather purchase a new battery or upgrade the laptop to a newer model. I just want a refund but they’re refusing. Is there anything I can do? Thanks in advance

It sounds like it’s not fit for purpose so you have a right to return for a refund0 -
Do you have a link to the laptop you purchased. Was it described as new or refurbished? How much was it?
You say the OS is so old you can’t do anything with it, what OS is it on, have you looked at upgrading the OS? Mac do these for free to an extent.
The battery also has an indicator on the laptop that tells you the battery strength. What is the battery strength and how many cycles has it done. How long does it hold a charge and what type of things does she use it for? Word processing won’t drain the battery as much as videos etc.0
